The Contract Labour (Regulation And Abolition) Himachal Pradesh Amendment Act, 2020

The Government of Himachal Pradesh vide notification no 06 of 2020 has repealed the Contract Labour (Regulation and Abolition) Himachal Pradesh Amendment Ordinance, 2020 with ordinary legislation to be known as the Contract Labour (Regulation and Abolition) Himachal Pradesh Amendment Act, 2020. As per the amendment, the applicability to the Act for the establishments employing twenty or more workmen is increased to thirty or more workmen. Please refer the notification for more details

The Industrial Disputes (Himachal Pradesh Amendment) Act, 2020

The Government of Himachal Pradesh vide notification no 05 of 2020 has repealed The Industrial Disputes (Himachal Pradesh Amendment) Ordinance, 2020 published on 9th July 2020 with ordinary legislation to be known as Industrial Disputes (Himachal Pradesh Amendment) Act, 2020. As per the amendment, the provision of the prohibition of strikes and lock-outs now includes non-public utility service as well along with public utility service within the provisions of the Act (b) The conditions for retrenchment compensation has been enhanced to sixty days from the earlier fifteen days average pay for every completed year of continuous service or any part thereof more than six months. Himachal Pradesh

The Factories (Himachal Pradesh Amendment) Act, 2020

The Government of Himachal Pradesh vide notification no 07 of 2020 has repealed the Factories (Himachal Pradesh Amendment) Ordinance, 2020 published on 9th July 2020 with ordinary legislation to be known as Factories (Himachal Pradesh Amendment) Act, 2020. As per the amendment, the Government has increased the threshold limit for applicability to the Factories Act, 1948 from ten or more workers to twenty or more workers for factories operating with the aid of power and from twenty or more workers to forty or more workers for factories operating without the aid of power. The total number of hours for overtime shall not exceed one hundred and fifteen hours instead of seventy-five hours subject to the condition that overtime shall have to be paid twice the rate of ordinary wages. Himachal Pradesh

The Industrial Employment (Standing Orders) Himachal Pradesh (Amendment) Rules, 2020

The Government of Himachal Pradesh vide Gazette notification No. Shram (A)3-5/2012-P-II has amended The Industrial Employment (Standing Orders) Himachal Pradesh Rules, 1973 to incorporate the provision of Rule 3(A) which provides that the employer of an industrial establishment shall not convert the posts of the permanent workmen to fixed-term employment and similarly included "fixed-term employment workman" under Schedule I of Model Standing orders with conditions that facilities such as hours of work, wages, allowances and other statutory benefits shall not be lesser than the facilities for the permanent workman. Gujarat

Resolution Towards Digitalisation Of Labour Related Records And Registers In Gujarat

The Government of Gujarat vide resolution no.FAC/142020/394384/M3 has allowed for digitalization of labor-related records and to move towards a regime of online maintenance of all labour related records by establishments/industrial units. As per the resolution, the registers and records required to be kept as per the labour laws will be maintained electronically, and therefore, the inspectors are instructed to follow accordingly during inspections. The Government may further clarify with notification on the process towards electronic maintenance of records. Please refer to the notification for more details

Tamil Nadu

Extension Of Period For Renewal Of Registration Of Workers Under Various Boards In Tamil Nadu

Government of Tamil Nadu vide notification no G.O.Ms.No.147 has extended the period of renewal of registration for workers and cut-off date for submission of life certificate, to 31st December 2020. This extension is applicable for workers registered under Tamil Nadu Construction Workers Welfare Board and Tamil Nadu Manual Workers Social Security and Welfare Board. Maharashtra

Further Extension Of Due Date For Filing Annual Returns Under The Maharashtra State Tax On Professions, Trade, Callings, And Employments Act, 1975

Government of Maharashtra, Finance Department in exercise of the power conferred under Section 6(3) of The Maharashtra State Tax On Professions, Trade, Callings, And Employments Act, 1975 had amended the earlier Government Notification (Finance Department, No. PFT-2014/C.R.-38/Taxation-3 dated 21st August 2014 ) on 22nd June 2020. This amendment essentially was made to help employers who couldn't pay tax or submit return up to the month of June 2020 was extended for filing on or before 31st July 2020. Now as per notification No.PFT 1220/CR 21/Taxation-3 the Government of Maharashtra has further extended the due date to pay tax or submit return on or before 30th September 2020 on the website of the Maharashtra Goods and Service Tax Department. Therefore, Tax and interest shall be paid before filing of return for the month of June 2020

Further Extension Of Time Limit To Deposit Labour Welfare Fund In Maharashtra

The Government of Maharashtra through the official website of Maharashtra Labour Welfare Board has published a notice on the webpage intimating further extension of the last date for payment of contribution to the Labour welfare fund till 15th September 2020. The official notification is yet to be released by the Labour Welfare Board, Government of Maharashtra. Relaxation In Eligibility Criteria And Enhancement In The Payment Of Unemployment Benefit Under Atal Bimit Vyakti Kalyan Yojana Of ESIC

ESIC vide notification No. E-13/12/9/2020-P.R. had launched the 'Atal Bimit Vyakti Kalyna Yojna' (ABVKY) a scheme under which unemployment benefit is paid to the workers covered under ESIC Scheme. The ESIC has now decided to extend the scheme for one more year up to 30th June 2021. It has been decided to relax the existing conditions and enhance the amount of relief for workers who have lost employment during the Covid-19 pandemic period. The enhanced relief under the relaxed conditions will be payable during the period of 24th March 2020 to 31st December 2020. Thereafter the scheme will be available with original eligibility condition during the period 1st January 2021 to 30th June 2021. The eligibility criteria for availing the relief have also been relaxed, as under: (i), The payment of relief has been enhanced to 50% of the average of wages from earlier 25% of average wages payable up to a maximum of ninety days of unemployment. (ii) Instead of the relief becoming payable ninety days after unemployment, it shall become due for payment after thirty days. (iii) The Insured Person can submit the claim directly to ESIC Branch Office instead of the claim being forwarded by the last employer and the payment shall be made directly in the bank account of the Insured Person. (iv) The Insured Person should have been insurable employment for a minimum period of two years before his/her employment and should have contributed for not less than seventy-eight days in the contribution period immediately preceding to unemployment and minimum seventy-eight days in one of the remaining three contribution periods in two years prior to unemployment.
