Introduction Of Online Payment Gateway Towards Payment Of Labour Welfare Fund In Maharashtra
The Government of Maharashtra vide notification no 2019-20/413 has introduced online payment gateway under ease of doing business for payment of labour welfare fund. The online payment gateway can be accessed through website provided here as https://public.mlwb.in/public. Therefore, online payment gateway shall be effective from 1st January 2020 . All establishments shall register in mentioned website (one time only) and provide the details of the worker and employer subscription. The payment can be done through Debit Card / Credit Card / Net Banking / Payment Apps / using the facility of Secure Payment Gateway/ NEFT / RTGS. Karnataka
The Karnataka Industrial Employment (Standing Orders) (Amendment) Rules, 2019
Government of Karnataka vide notification No: LD 268LET 2016 (P-l) has amended Schedule 1 of the Karnataka Industrial Employment (Standing Orders) Rules, 1961. As per the amendment, every Industrial Establishment operating or carrying on business in Karnataka shall give priority appointment to Kannadigas who are Indian citizens and are residing in Karnataka for not less than fifteen years (15) and are able to read, write and speak Kannada language subject to suitability, qualification, experience and other requirements in case of workmen. The amendment has further mandated that every industrial establishment shall provide not less than five percent of employment to persons with bench mark disabilities as defined in clause (r) of section 2 of the Rights of Persons with Disabilities Act, 2016 in case of workmen in order to get incentive from the Government. Implementation Of The Transgender Persons (Protection Of Rights) Act And Rule For All Establishments
The Central Government has implemented The Transgender Persons (Protection of Rights) Act, 2019 and The Transgender Persons (Protection of Rights) Rules, 2020 on all establishments including private establishments to protect the rights of transgender persons and their welfare. As per the Act and Rule, (1) Every establishment shall implement all measures for providing a safe working environment and to ensure that no transgender person is discriminated against in any matter relating to employment including, but not limited to, infrastructure adjustments, recruitment, employment benefits, promotion, and other related issues. (2) Every establishment shall publish an equal opportunity policy for transgender persons. The equal opportunity policy of an establishment shall, inter alias, contain details of- (a) infrastructural facilities (such as unisex toilets), measures put in for safety and security (transportation and guards) and amenities (such as hygiene products) to be provided to the transgender persons to enable them to effectively discharge their duties in the establishment. (b) applicability of all rules and regulations of the company regarding the service conditions of employees. (c) confidentiality of the gender identity of the employees. ESIC Circular On Delay In Registration Of Employee
ESIC based on representations received from employers on recently introduced restriction in system for registration of employee, vide circular No:-P-11/12/Misc./SST Misuse/2019-Rev.II has approved new process for employer in the system while carrying out the online registration of an employee wherein date of appointment is more than ten days before, from the date of online registration. In this regard the ESIC portal will accept the registration of employees where difference between the date of appointment and date of registration is more than 10 days, provided that system will request to accept or reject the conditions mentioned for registration of an employee. If employer accepts the conditions insurance number will be allotted and a show cause notice shall be issued to the registered email id of the employer. The employer shall submit relevant reply/records within 15 days of issue of Show Cause Notice to the concerned RO/SRO in the prescribed proforma. If employer rejects the conditions, then the system will redirect the employer to change the date of appointment. Please refer the notification for detailed information
