Central

UAN Generation Without Aadhaar For Residents Of Assam, Meghalaya And Nagaland

The EPFO as per circular dated 29th August 2018 has cited reasons that since the penetration of Aadhaar is very low in Assam, Meghalaya and Nagaland, many requests were received from employers for allowing generation of UAN without using Aadhaar. Hence, EPFO has made a provision in the Unified Portal in the Establishment login for the generation of UAN without Aadhaar for employees residing in any of the three states mentioned. It is allowed for a period of three months from 24th August 2018 to 23rd November 2018. Please refer to the circular for detailed process flow

The Kerala Minimum Wages Notification (June 2018)

Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No. P3.Pdl.1/2018/DES, the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of June 2018 are as ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act

Registration Or Licenses Issuance Made Online Though Shram Suvidha Portal Under Certain Central Labour Laws

The Ministry of Labour and Employment, Govt. of India, has launched Online Registration/Licensing under Contract Labour (Regulation And Abolition) Act,1970, Inter-State Migrant Workmen (Regulation Of Employment And Conditions Of Service) Act, 1979 and The Building And Other Construction Workers (Regulation Of Employment And Conditions Of Service Act, 1996 through Shram Suvidha Portal. Therefore, all Principle employers/Contractors are hereby requested to apply for Registration/Licenses under above applicable acts Online only through Shram Suvidha portal. The Maharashtra Minimum Wages Notification (July 2018)

Government of Maharashtra has released revised minimum rates of wages (variable dearness allowance) effective 1st July 2018 which will be valid till 31st December 2018

Delhi

The Delhi Minimum Wages Notification Annulment Judgment

The Delhi high court by its Judgement on 4th August 2018 has quashed the Notifications issued by Delhi Government bearing no. F-13(16)/MW/1/2008/Lab/ 1859 dated 15th September, 2016 constituting the Minimum Wages Advisory Committee for all scheduled employments and the Notification bearing no. F.Addl.LC/Lab/MW/2016 dated 3rd of March 2017 revising minimum rates of wages for all classes of workmen/employees in all scheduled employments. Hence employers are not bound or have to compulsorily pay the Minimum wages as per the aforementioned notification and those employers who have not effected the revision and are paying above the Minimum wages notified prior to the March 3, 2017 are fully compliant. And in further directions issued by the Delhi High Court on this Judgement has stated that those Employers who have already complied with the Minimum Wages as notified on 3rd of March 2017 cannot recover the wages from employees to whom it has been paid. The employers who had revised the wages to comply with the Minimum Wages as per the quashed notification cannot automatically revert back to then existing wages, because the wages is part of employment contract that cannot be significantly altered just for the reason that Minimum wages notification has been quashed and any reduction in the wages of the employees may have implications on other statutes as well. And when an employer is providing better benefits than statutory requirements, then that cannot changed just for the reason of the fact that statute provided for a lesser benefit. It is advisable for the Employers to await further action by the Delhi Government, whether they would prefer an appeal against this Judgment or reconstitute the Minimum Wages advisory committee and try to follow the process that overcomes all the issues mentioned in the judgement and might come back with a notification that reiterated the Minimum Wages as per March 2017 notification
