The Employees Compensation (Amendment) Act 2017 Effective Date Released
Government of India, Ministry of Labour and Employment had earlier on 12th April 2017 released the Employee's Compensation (Amendment) Act 2017 stating that the effective date shall be notified in the near future. Thus, as per recent notification dated 12th May the effective date for the act has been fixed as 15th May 2017

Implementation Of Draft Benefit Transfer Through Electronic Mode
As per EPFO Circular dated 8th May 2017, EPFO has given clarification on the amendments made to the EPFS, EPS and EDLI Scheme as per notification released in the Official Gazette by the Ministry of Labour and Employment on 4th May 2017. EPFO has stated that as per the amendments, all the payments may be made to the beneficiaries through electronic or digital fund transfer system only

Clarification On Additional Two Years Pensionable Service Weightage To Members Of EPS
As per EPFO circular dated 8th May 2017, EPFO has given clarification on the amendment made to the Employees Pension Scheme by notification released in the official gazette on 23rd June 2009. EPFO has stated that after amendment that was in effect from 24th July 2009 a member is eligible for benefit of 2 year weightage of service provided he superannuates on attaining the age of 58 years and he has rendered 20 years pensionable service or more, prior to amendment member had to fulfil either only one of the two conditions or both. Thus, if a member of EPS fulfils both these conditions then his pensionable service shall be increased by adding a weightage of 2 years

As per The Taxation Laws (Amendment) Act, 2017 published in the official gazette dated 5th May 2017, Section 18 of the Act provides for repeal of laws and the extent of repeal in the Third Schedule of the Act. The Third Schedule of the Act clearly states that The Water (Prevention and Control of Pollution) Cess Act, 1977 has been wholly repealed. The water cess was earlier being collected by the SPCBs (State Pollution Control Boards) / PCC (Pollution Control Committee), as per the GST guidelines the cess will now be subsumed in the Goods and Services Tax (GST). Thus, collection of water cess from certain industries under The Water (Prevention and Control of Pollution) Cess Act, 1977 shall be withdrawn and instead will be covered under GST with effect from 1st July 2017

As per EPFO Circular dated 4th May 2017, the EPFO has observed that since there are difficulties in submission of aadhaar along with pension claims from North East Region, with reference to the same EPFO has decided that aadhaar may not be insisted for pension (10 D) claims for members working in establishments located in the North Eastern states till 30th September 2017. However, all efforts are being made for linking aadhaar for members and pensioners under Employee Pension Scheme, 1995 as early as possible

Online Claim Submission By Member Using UAN Interface
As per recent EPFO Press Release dated 1st May 2017, the EPFO has stated that all EPF Member’s who have activated their UAN and seeded their KYC (Aadhaar) with EPFO will be able to apply for PF Final Settlement (Form 19), Pension Withdrawal Benefit (Form 10-C) and PF Part Withdrawal (Form 31) from their UAN Interface directly. A member can complete the whole process online and member neither needs to interact with the employer and nor with EPFO field office to submit the online claim. Member is not required to give any supporting document while preferring online PF Part Withdrawal case. A member applying online will be taken as his self-declaration for preferring the claim. To apply for this service member’s Aadhar details should be seeded in EPFO database. The facility is expected to ease the claim submission process for EPF members and reduce the turnaround time

Launch Of One IP- Two Dispensaries Scheme
As per Press Information Bureau release dated 1st May 2017, the Ministry of Labour and Employment has launched One IP- Two Dispensaries Scheme. Under One IP- Two Dispensaries scheme there is an option given to an Insured Person (IP) to choose two dispensaries, one for self and another for family through an employer. Earlier Insured person had to choose one dispensary for either self or for family. This will benefit all Insured persons, especially migrant workers who are working in other than home State, while their families are living in their native States, because of non-availability of option of second dispensary, the dependant members of family are often deprived of medical benefits

Declaration Of Rate Of Interest For EPF Members Account For The Year 2016-17
As per recent EPFO Circular dated 27th April 2017, the EPFO has reiterated the Notification of Ministry of Labour and Employment conveying the approval of Central Government to credit interest at 8.65% for the year 2016 -17 from 8.80% for the year 2015-16, to the account of each member of the EPF Scheme as per provisions under Para 60 of EPFS

Introduction Of Real Time System In EPFO Default Management
As per recent EPFO circular dated 25th April 2017, the EPFO has made it clear that it is in process of making a default management system and the EPFO has laid down some of the salient features, which include, an SMS alert being sent on 16th/17th of every month to those employers who have made atleast one contribution during the last three months but failed to contribute during the month, informing them the due date for payment. Thereafter an E-Mail communication shall be sent between 20th to 25th of every month to all those balance establishments who had remitted any contributions during the last three months but have not remitted any contribution during the month. Simultaneously, field offices shall be supplied the list of all such balance establishments for their own viewing in protected view in MIS Portal. The officers-in-charge have been directed take action against the establishments who have not remitted their contribution. It is further proposed to publish defaulting establishments in EPFO Website for public view. Thus, the EPFO has set up a system of sending alerts to ensure timely payments and at the same has issued strict instructions to officers to take action on non-remittance and for publishing defaulter list in the EPFO website. This is to enable employers to make timely remittances

Self Declaration For Advance Granted For Illness And For The Physically Handicapped
Government of India vide gazette notification dated 25th April 2017, has made amendments to the Employees Provident Funds Scheme. Under Para 68-J and in Para 68-N for grant of advance from the fund in case of illness and to members who are physically handicapped, the earlier required provisions for requirement of a certificate from a doctor of the hospital, a certificate from his employer that the ESI benefits are not applicable and medical certificate from a competent medical practitioner to the effect that person is physically handicapped respectively have been removed. Thus, as per the changes made under the amendments to the EPFS a member can submit a self declaration to get the advance for illness under Para 68-J and the advance for the physically handicapped under Para 68-N
