Tamil Nadu

The Tamil Nadu Shops And Establishments (Amendment) Act, 2017 Effective Date Released

The Government of Tamil Nadu, by notification in the Official Gazette has made changes to the Tamil Nadu Shops and Establishments Act, 1947, under various sub-sections and provisions. Effective 1st April 2017 below mentioned changes shall come into force: (i) New section 2-A has been inserted which provides that the appellate authority may call for and inspect document or summon and examine a person for his testimony, and for those purposes shall have powers of civil court. (ii) New section 2-B has been inserted which provides that the appellate authority may dismiss the appeal or direct the reinstatement of the person employed or direct payment of compensation etc. (iii) The Penalty for contravening sections 7 to 11, 13 to 23, 25, 26, 29 to 41 and 47 for a first offence has been increased from twenty-five rupees to five thousand rupees and for a second or subsequent offence the fine has been increased from two hundred fifty rupees to ten thousand rupees

The Rationalisation Of Forms And Reports Under Certain Labour Laws Rules, 2017

As per notification published in the official gazette by the Ministry of Labour and Employment dated 28th March 2017, various forms under the following rules Contract Labour (Regulation and Abolition) Central Rules, 1971, The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Central Rules, 1980 and The Building and Other Construction Workers’ (Regulation of Employment and Conditions of Service) Central Rules, 1998 have been substituted. The changes under the mentioned rules have been in forms for registration and renewal among other important forms

Reduction In Timeline For Grant Of License And Abolition Of Physical Application

Delhi Labour Department has notified timelines for delivery of services where Time Limit For Grant Of License And Registration Under Contract Labour Act has been fixed at seven days, Time limit for grant of license under BOCW has been fixed at seven days and the time limit for approval of factory building plan under Factories Act has been fixed at three days. No application shall be accepted in physical form w.e.f 29-03-2017. Existing mode of payment of wages to workers/ employees through cheques/ECS/bank transfer and uploading of the same on the website will continue to be in operation

Karnataka

Retirement Age Of Workmen Changed To Sixty Years

The Karnataka Government as per notification in the official gazette dated 28th March 2017 has amended The Karnataka Industrial Employment (Standing Orders) Rules, 1961. As per the amendment, the age for retirement or superannuation of workmen has been changed from 58 years to 60 years

Payment Of PF And Withdrawal Benefit Under Pension Scheme On The Date Of Leaving Service To International Workers

As per EPFO Circular dated 23rd March 2017, the EPFO has decided that in order to facilitate benefit to International Workers on retirement, the employer shall make payment of contribution of retiring International Workers with in first three days of the month in which the said member is retiring, through separate ECR. The employer shall also submit the claim forms in respect of such International Workers, complete in all respect, in the concerned PF office by 6th of the month in which such member is leaving service. In case the International Worker desires interest on the settlement amount for the month of retirement also, the PF Claim settlement amount shall be credited to the member's account on the first day of the next month

Central

Allowing EPS Members The Benefit Of The Actual Salary In Pension Fund Exceeding Wage Limit

As per EPFO Circular dated 23rd March 2017, the EPFO has stated that for situations in which the deposit of employer's share of contribution of 12 % was on actual salary and not on ceiling amount, PF withdrawn by members could be sought to be refunded by PF Commissioner, before granting members the benefit under this order. Members of the EPS, 1995 who had contributed on higher wages exceeding the statutory wage ceiling of Rs 6500 in the Provident Fund may now divert 8.33% of the salary exceeding Rs.6500/- to the Pension Fund with up to date interest as declared under EPF Scheme, 1952 from time to time to get the benefit of pension on higher salary on receipt of joint option of the Employer and Employee. Thus, a member contributing to the Provident Fund on the wages exceeding statutory ceiling can now contribute on such higher wages to the pension fund and such higher sum contributed to PF can be diverted to the pension scheme

Tamil Nadu

Tamil Nadu Shops Permitted To Remain Open 365 Days A Year For Three Years

Governor of Tamil Nadu in public interest has exempted all establishments from the provision of sub-section (1) of Section 11 of the Tamil Nadu Shops and Establishment Act and has permitted all the establishments in the State of Tamil Nadu to keep open on all 365 days of the year, for a further period of three years with effect from 23rd March 2017. (Please refer the notification for detailed information)
