Guidelines To Settle the Legitimate Dues Of Workers Under Payment of Bonus Act, 1965 In West Bengal

The Government of West Bengal vide circular No. Labr./420/(LC-IR)/22013/56/2019 has issued guidelines to be followed by all employers and employees of the state covered under the Payment of Bonus Act, 1965 (''Act''). The guidelines require establishments to pay bonus including employees in casual employment/re-employment after retirement/employed through contractors. The guideline further provides that the payments of bonus should be completed by September 23, 2022, to all Muslim employees/workers before Id-UI-Fitre. Please refer to the circular for more details

Relaxation Of Time Limit For Filing And Depositing ESI Contribution

The ESIC vide circular No. P-11/12/Misc./1/2019 (M)- Rev.II provided relaxation of the time limit of depositing and filing ESI contributions by the employer. The time limit for depositing contributions for the month of March 2022 is extended from 15th April 2022 to 30th April 2022 and the time limit for filing the return of contribution for the period of October 2021 to March 2022 is extended from 11th May 2022 to 26th May 2022. ESIC Relaxed Condition Under COVID-19 Relief Scheme

The ESIC vide notification No. N-12/13/01/2019-P&D has relaxed the eligibility condition for providing relief under the Covid-19 relief scheme, which should have been paid or payable during a maximum period of one year immediately preceding the diagnosis of COVID-19 disease resulting in death. The Authority has reduced the minimum eligible period of contribution to thirty-five days from the earlier seventy days. Please refer to the notification for more information.

The Employees State Insurance (Central) Amendment Rules, 2022

ESIC vide notification no.G.S.R. 176 (E ) has amended provision on sickness benefit under The Employees’ State Insurance (Central) Rules, 1950. As per amendment, insured women who are receiving maternity benefit can also claim sickness benefit i.e cash benefit in case shorter contribution period is available to her, provided that contribution shall be payable for not less than half the number of days available for working in such contribution period. Therefore, amendment entitle insured women to claim the sickness benefit and such retrospective amendment shall not prejudicially affect any beneficiary of any other benefit entitled under Employees’ State Insurance Act, 1948. EPFO Circular On Trainees Under National Employability Enhancement Mission (NEEM)

EPFO vide circular No.Compliance/NEEMscheme/2021 recommended to all additional central provident fund commissioner and Zonal commissioners that provisions towards The Employees Provident Fund And Miscellaneous Provisions Act, 1952 will be applicable for the students getting placement in companies and appointed as employee of the establishments even during job or training or induction and other trainings taken after becoming employee. Therefore, Trainees Under National Employability Enhancement Mission are not exempted from the definition of "employee" under The Employees Provident Fund And Miscellaneous Provisions Act, 1952. Relaxation Of Eligibility Condition Under Atal Beemit Vyakti Kalyan Yojana

ESIC vide notification No. N-12/13/01/2019-P&D has decided to relax the eligibility condition of two years insurable employment before unemployment and contributory condition of Atal Beemit Vyakti Kalyan Yojana with effect from 01st July 2021. As per notification, insured person should have been in insurable employment for a minimum period of twelve months immediately before his or her unemployment and should have contributed for not less than seventy eight days in the one completed contribution period in twelve months immediately preceding to unemployment. Circular Towards Linking Of ESIC Of Insured Person With EPFO

ESIC vide circular has decided to link ESIC insurance number of insured person with the EPFO's Universal Account Number (UAN), a twelve digit identification number number allotted by EPFO. Therefore, members of EPFO with authorised Aadhaar and Bank details seeded against the UAN can submit their provident fund withdrawal or settlement or transfer requests. An arrangement has been made in the ESI portal where the employer can enter the UAN of IPs through the module. Once after entering details in the system the same can be verified with EPFO. Hence employer may take note on ease of access to the facilities as mentioned

Extension Of Atmanirbhar Bharat Rojgar Yojana (ABRY)

EPFO vide publication in web portal has extended the registration facility under Atmanirbhar Bharat Rojgar Yojana (ABRY) from 30th June 2021 to 31st March 2022 . As per the scheme, (1) incentive shall be in the form of payment of employee and employer contribution which is twenty four percent of wages in respect of new employees employed in establishments having more than one thousands employees, (2) establishments registered with EPFO after 1st October 2020 shall get the benefits in respect of all new employees.
